These Terms of Use (“Terms”) set out the basis on which you may access and use the GiftingBot Discord bot (the “Bot”) and the website located at https://giftingbot.com
(together, the “Service”).
The Service is operated by Keymailer Limited, a company incorporated in England and Wales (company number 09569579, registered office at 19 Rylestone Grove, Bristol,BS9 3UT) trading as Partnier.com (“we”, “us”, “our”).
By installing or using the Bot, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Relationship with Other Terms
1.1 The Service integrates with and relies on the platform available at https://partnier.com and its associated portals (including, without limitation, Keymailer and Game.press).
1.2 Your use of the Service is subject to and conditional on your continued compliance with the Partnier.com Terms of Service and the terms of any relevant Partnier portal you access.
1.3 In the event of conflict, the Partnier.com Terms prevail with respect to the platform and related services, while these Terms govern your use of the Bot and your interactions within Discord.
2. Relationship with Discord
2.1 The Bot operates within Discord. Your use of Discord is subject to Discord’s own terms and policies.
2.2 We are not responsible for Discord’s platform, functionality or availability, nor for any changes Discord makes that affect the Service.
3. Who May Use the Service
3.1 You may use the Service only if you are at least 13 years old (or the minimum age required by Discord in your country) and, if under 18, with the consent of a parent or guardian.
3.2 If you install the Bot on a Discord server, you confirm that you are the owner or an authorized administrator of that server.
3.3 End users who interact with the Bot in a Discord server must hold a valid account on the relevant Partnier platform (e.g. Keymailer, Game.press) and their use is governed by that platform’s terms.
4. Accounts, Linking and Authorization
4.1 To use the Service, you must link your Discord server with your Partnier.com account.
4.2 You are responsible for maintaining the security of your Partnier.com account and for all activity that occurs under it via the Bot.
4.3 Actions taken through the Bot are deemed authorized by the Partnier.com account holder.
5. Free and Paid Use
5.1 The Service is available in both free and paid modes. Paid features are managed and billed through your Partnier.com account.
5.2 Fees, payment terms and billing arrangements are governed by the Partnier.com Terms.
5.3 We may change, suspend or discontinue free or paid features at any time, with reasonable notice where required.
6. Acceptable Use
You must not use the Service to:
- break the law or infringe the rights of others;
- distribute unlawful, harmful, misleading or infringing content;
- harass, abuse or harm others;
- interfere with or damage the Service, Discord, or any connected systems;
- attempt to gain unauthorized access to accounts or data.
We may suspend or terminate your access if you breach this clause.
7. Availability
7.1 We provide the Service using reasonable skill and care but do not guarantee uninterrupted or error-free operation.
7.2 The Service may be affected by outages or changes in Discord, Partnier.com or other third-party services. We are not liable for such interruptions.
8. Termination and Suspension
We may suspend or terminate your access to the Service immediately if:
- you breach these Terms or the Partnier.com Terms;
- required by law or regulation;
- necessary to protect the security, integrity or proper operation of the Service.
On termination, your rights to use the Service cease immediately.
9. Intellectual Property
9.1 All intellectual property rights in the Bot, the Service and our branding belong to us or our licensors.
9.2 We grant you a limited, revocable, non-exclusive, non-transferable license to use the Bot solely for its intended purpose.
9.3 We do not claim ownership of any content you input via the Service.
10. Data Protection & Privacy
10.1 We process personal data in accordance with our Privacy Policy.
10.2 By using the Service, you consent to such processing and you warrant that all data provided by you is accurate.
11. Liability
11.1 The Service is provided “as is”. To the fullest extent permitted by law, we disclaim all warranties, conditions and representations, express or implied.
11.2 We are not liable for:
- loss of activation codes, data, digital assets or content;
- misuse of codes or assets by end users;
- loss arising from Discord or other third-party platforms;
- indirect, consequential, incidental or economic loss.
11.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded by law.
11.4 If you are a consumer, these Terms do not affect your statutory rights.
11.5 Our total liability to you for any claim arising out of the Service is limited to the greater of: (a) £50, or (b) the amount you paid for the Service in the 12 months before the claim.
12. Changes to these Terms
We may update these Terms from time to time by posting a new version on https://giftingbot.com. Changes take effect from the date of posting. Your continued use of the Service constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. If you are a business, the courts of England and Wales shall have exclusive jurisdiction. If you are a consumer, you may bring claims in your local courts where required by law.
